1. Basic facts

A. On March 20, 2013, the Plaintiff entered into a health insurance contract with the Defendant and the beneficiary for a non-payment of dividends from March 20, 2013 to March 20, 2061.

The insurance contract of this case contains a renewal-type cancer diagnosis cost (excluding small-sum cancer), renewal-type cancer diagnosis cost special agreement (guarantee amount of KRW 20 million), renewal-type cancer diagnosis cost special agreement (guarantee amount of KRW 20 million), renewal-type high-amount diagnosis cost special agreement (guarantee amount of KRW 40 million).

(hereinafter “instant insurance contract”). (b)

The main contents of the instant insurance contract are as follows.

Article 1 of the Terms and Conditions of the Contract for Cancer (excluding small cancer) which provides for cancer diagnosis expenses shall be paid to the beneficiary when the insured is diagnosed as a general cancer (excluding small cancer) after the date of commencement of guarantee during the insurance period.

Article 3(2) General cancer means cancer excluding Athroid cancer and other skin cancers, which is classified as malicious life (Athroid cancer) in the sixth Korean Standard Disease Classification and Death Classification.

(4) General cancer (excluding small cancer) means cancer excluding small cancer in general cancer, and small-sum cancer means malicious life in an anti-virative line, malicious life in an anti-virative line, and other diseases specified in attached Table 11.
