Reasons

Punishment of the crime

The Defendant is a person employed as the managing director of the above apartment management office around March 10, 2017, who was a managing director of the above apartment management office, from May 1, 2017 to July 15, 2017, and served as the head of the above apartment management office.

1. On May 4, 2017, the Defendant: (a) connected with the Korea Appraisal Board’s multi-family housing management information system using computers at the above apartment management office; and (b) removed electronic documents, such as a public announcement of tender and a notice of tender attached thereto, and a notice of qualification examination, from the above system, by arbitrarily cancelling a public announcement of tender, which was posted on the above system through a resolution by the council of occupants’ representatives in order to select a new housing management entity; and (c) arbitrarily cancelling a public announcement of tender; and (d) deleted

Accordingly, the defendant damaged electronic records and interfered with the public announcement of tender for the selection of the victim's housing management company.

2. On May 6, 2017, the Defendant: (a) demanded that the victim E, the president of the said apartment complex, who is the president of the said apartment complex, convene a regular meeting necessary for the selection of a new housing management company by telephone at an irregular place; (b) the head of the said apartment management division, who keeps the president’s official seal attached the said official seal in a regular meeting announcement; (c) the said F, using the position of the head of the management division, who is in the position of the head of the management division in which he/she should follow his/her direction, order F not to affix his/her official seal on the convocation announcement; and (d) the victim demanded F to keep the said official seal on the books of the victim; (c) thereby, the victim interfered with the victim’s duty of convening the regular meeting announcement by forcing F not to transfer his/her official seal.

3. The Defendant causing property damage is an apartment building above around 15:20 on July 10, 2017.
