The judgment below

The part against the Defendants is reversed in entirety.

Defendants shall be punished by imprisonment with prison labor for one year and two months.

1. The sentence of the lower judgment against the Defendants on the summary of the grounds for appeal (the Defendant A: imprisonment of one year and four months and fine of 20,000,000, confiscation, additional collection, Defendant C: Imprisonment of one year and six months and fine of 20,000,000, additional collection) is too unreasonable.

2. 직권판단 피고인들의 항소이유에 대하여 판단하기에 앞서 직권으로 살피건대, 피고인들의 원심판시 각 범죄사실은 피고인들이 식품의약품안전처장에게 신고하지 않고 수입한 식품이자 기준ㆍ규격이 고시되지 아니한 화학적 합성품이 함유된 식품인 비그로, 칵스타 등을 판매하였다는 것이므로 이는 하나의 행위가 수개의 죄에 해당하는 상상적 경합 관계임에도 불구하고 원심은 이를 실체적 경합 관계로 보아 그 형을 가중한 잘못을 범하였고, 이러한 잘못은 판결에 영향을 미쳤다고 할 것이므로 이 점에서 원심판결은 파기를 면할 수 없다.

Therefore, under Article 364(2) of the Criminal Procedure Act, without examining the Defendants’ assertion of unfair sentencing, the part of the lower judgment against the Defendants is reversed ex officio and the following decision is rendered through pleadings.

Criminal facts

The summary of the evidence and the criminal facts of the defendant recognized by this court and the summary of the evidence are as follows: "The defendant sold food containing chemical synthetics, the standards and specifications of which are not publicly notified, and imported food, etc. without filing a report with the Minister of Food and Drug Safety," and except that the "standard specifications" in the 4th, 8th, and 5th, are the same as the stated in each corresponding column of the judgment of the court below, and thus, they are cited in accordance with Article 369 of the Criminal Procedure Act.

Application of Statutes

1. The sale of imported foods not reported under Article 94 subparagraph 1 of Article 94 of the Food Sanitation Act, Articles 4 subparagraph 6 and 19 (1) of the same Act, and Article 30 of the Criminal Act concerning criminal facts;
