Defendant

A Defendant shall be punished by imprisonment with prison labor of two years and six months, and fine of 400,000,000 won.

However, for a period of four years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Defendant A

(a) No person who violates the Act on Special Measures for the Control of Public Health Crimes (including manufacture, etc. of illegal foods) shall sell foods containing chemical synthetics, the standards and specifications of which are not publicly notified annually at retail prices of at least 50,000,000 won;

On August 26, 2013, the Defendant sold 100 copies (hereinafter “illegal-style sprink products”) of 150,000 won in total (hereinafter “illegal-style sprink products”) of 150,00 won in total, 15,000 won in total retail value, 15,000,000 won in total retail value, and 30,000 won in total, 15,000,000 won in total, from around that time to March 4, 2015.

Accordingly, the Defendant sold an unauthorized manufacturing food containing chemical synthetics with retail prices of at least 50,000,000 won per annum, for which standards and specifications are not publicly notified.

(b) No person who violates food sanitation law shall sell foods containing chemical synthetics, the standards and specifications of which are not publicly announced;

1) On March 20, 2017, the Defendant received 3,500,000 won from E and sold 200 copies of the “illegal Roster Products” to E in a golf practice place with an influent address (hereinafter referred to as “Muyang-si”).

2) On April 4, 2018, the Defendant received 4,000,000 won from E and sold 200 copies of the “illegal Gap Pol Products” to E in a golf practice site with an address of no more than 4,000,000 won.

As a result, the Defendant received a total of KRW 7,500,000 on two occasions and received a total of KRW 7,50,000, and the standards and specifications are not publicly notified, “illegally manufactured foods containing chemical synthetics.”
