1. As to KRW 1,757,439,00 and KRW 200,00 among the Plaintiff, the Defendant shall start from September 18, 2018 to November 12, 2019.
Reasons
1. Facts of recognition;
A. The former land cadastre was written in Jeju-do, Jeju-do, Jeju-do (hereinafter “Bri”) 1,952, prior to C, as the network D.
B. The C previous 1,952 square meters was divided into 1,056 square meters and 887 square meters prior to C on August 1, 1955 (the conversion was made to 2,769 square meters, but was made to 2,769 square meters). The C previous 1,056 square meters was divided into 91 square meters prior to C on December 5, 1972 (the conversion was made to 3,276 square meters, and was converted to 3,469 square meters), and 65 square meters prior to F (the conversion was made to 215 square meters) and 65 square meters prior to C, while the said F preceding 3,469 square meters was divided into 3,100 square meters prior to C on May 1, 2010.
(C) 1,952 square meters prior to C before C/ [A land] 87 square meters prior to E/ [B] 87 square meters prior to C/C [C] 91 square meters prior to C/D [D land] 91 square meters prior to C/D] 65 square meters (215 square meters) [E] on F road 65 square meters prior to C/ [3,469 square meters prior to D] after division as of December 5, 1972 after dividing as of May 11, 2010 and dividing as of May 11, 2010 [F land] 3,110 square meters prior to C/G land [G land] 359 square meters prior to G.
C. The Defendant completed the registration of ownership transfer as Jeju District Court No. 10181, Sept. 18, 1969 with respect to land B, and the registration of ownership transfer as to land C due to sale on June 21, 1949, respectively.
On December 26, 2006, the Plaintiff and the Defendant concluded an exchange contract under which the Defendant would complete the registration of ownership transfer with respect to C land and D land (hereinafter “instant exchange contract”) to the Plaintiff in return for completing the registration of ownership transfer with respect to C land and D land prior to H in Jeju City.
Since then, the Defendant completed the registration of ownership transfer for the land C and D with each Jeju District Court No. 96675 on December 28, 2006, and the Plaintiff completed the registration of ownership transfer for the land C and D with respect to the Defendant on January 4, 2007 with respect to the land No. 3,874 square meters before H in Jeju City.
