1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On July 3, 1961, the Plaintiff’s father D was divided into M, N,O, P, Q, and R land in the previous 1,167 square meters of land in the previous 1,167 square meters of land in the Gu-si.
The registration of transfer of ownership is completed on the basis of the completion of repayment on December 12, 1955 with respect to 215 square meters in Gu and Si and Gu, Si and Gu.
B. On August 14, 1997, the Defendant: (a) bequeathed from the Defendant’s father G on August 14, 1997, KRW 253 square meters (hereinafter “instant Defendant’s land”) prior to Gumi-si C; and (b) completed the registration of ownership transfer on November 11, 1997.
C. Around 1973, the network D laid down a cement brick fence on the part of the Defendant’s land in question, including the part of 4, 5, 6, 7, and 3 square meters on the part of 41 square meters in the ship connected with the said land in sequence, which was connected with the said land, in the order of 3, 4, 5, 6, 7, and 3 of the attached drawings among the Defendant’s land in question (hereinafter “instant dispute land”), and the part of the ship that connected each point of 1, 3, 3, 7, 8, and 1 of the attached drawings, in sequence, connected each point of 1, 3, 3, 7, 8, and 1.
On March 6, 1989, Flux 215 square meters was divided into “F large 211 square meters” and “H large 4 square meters.” On March 5, 2007, the Flux 94 square meters (hereinafter “the instant land”) was divided into “the Plaintiff’s land”, “I large 56 square meters”, and “J large 61 square meters,” respectively.
E. On January 21, 2013, the Plaintiff completed the registration of ownership transfer in the name of the Plaintiff on the instant land due to the legacy of January 2, 2013.
F. Meanwhile, around October 2014, the Plaintiff was admitted as a fire-fighting road as part of the Plaintiff’s land, and removed the said house. On August 6, 2015, the Plaintiff completed the registration of ownership transfer for the Plaintiff’s land on the ground of sale on July 27, 2015.
