1. The Plaintiff:

A. Defendant B’s points in the separate sheet Nos. 2, 3, 8, 9, and 2, among the buildings listed in the separate sheet.

1. Determination on the cause of the claim

A. (i) The Plaintiff is the Housing Redevelopment Project Association which has obtained authorization for the establishment of a housing redevelopment project association with the area of 34,486 square meters which is located in JJ in Busan-gu.

D. The Plaintiff obtained authorization for the establishment of an association from the head of Busan District Office on March 6, 2008, and received authorization for the implementation of the project on March 3, 2009, the authorization for the change of the project implementation plan on February 29, 2012, and the authorization for the management and disposal plan on March 31, 2017 (hereinafter “the authorization for the management and disposal plan of this case”).

Secondly, on April 5, 2017, the head of Busan Busan District Government announced the management and disposal plan of this case.

x. K is the owner of the building indicated in the attached list in the project implementation district (hereinafter “instant building”), who is eligible for cash settlement because it did not apply for parcelling-out within the period of application for parcelling-out, and on October 10, 2017, the registration of ownership transfer in the name of the Plaintiff was completed with respect to the instant building.

⑸. 피고 B은 이 사건 건물 중 별지 도면 표시 2, 3, 8, 9, 2의 각 점을 차례로 연결한 선내 ㉯부분 약 29.9㎡에서 F를 운영하면서 이를 점유하고 있고, 피고 C는 이 사건 건물 중 별지 도면 표시 3, 4, 7, 8, 3의 각 점을 차례로 연결한 선내 ㉰부분 약 25㎡에서 미소렌트카 주식회사 G지점을 운영하면서 이를 점유하고 있으며, 피고 D은 이 사건 건물 중 별지 도면 표시 11, 12, 15, 16, 11의 각 점을 차례로 연결한 선내 ㉲부분 약 43.55㎡에서 H을 운영하면서 이를 점유하고 있고, 피고 E은 이 사건 건물 중 같은 도면 표시 12, 13, 14, 15, 12의 각 점을 차례로 연결한 선내 ㉳부분 약 74.1㎡(이하 피고들이 각 점유하는 부분을 통틀어 ‘이 사건 각 건물부분’이라 한다)에서 I을 운영하면서 이를 점유하고 있다.

⑹. 원고는 피고들과 손실보상의 협의가 성립되지 않자 부산광역시지방토지수용위원회에 수용재결을 신청하였고,...
