The punishment of the accused shall be determined by eight months of imprisonment.

However, the above sentence shall be executed for two years from the date of the final judgment.

No game products related business entity shall allow others to gamble or perform other speculative acts, or leave them unattended so that they may do so by using a game product.

그럼에도 불구하고 피고인은 2015. 9. 11.경 광주 동구 E 1층에 있는 168.16㎡ 규모의 ‘F’라는 상호의 게임장을 운영하면서, 위 게임장에 드래곤혈전 게임기 40대, 태풍 게임기 30대, 바다구만 게임기 20대, 로얄고도리 게임기 2대, 투신 게임기 20대 등 게임기 112대를 설치한 후 2015. 12. 16.까지 위 게임장에 찾아 온 손님들이 게임기에 현금을 투입하고 자동진행장치(일명 똑딱이)를 이용하여 게임 이용자의 적극적인 참여가 없이 자동으로 게임을 진행하게 한 후 게임을 통해 획득한 점수에 해당하는 무료이용권을 발급하여 주고 이후에 무료이용권을 제시하면 무료이용권에 해당하는 점수를 게임기에 투입하여 점수를 재사용할 수 있도록 해주고, 손님들이 위 게임장 안팎에서 무료이용권을 다른 손님들에게 판매하거나 환전상에게 판매하여 현금화할 수 있도록 하였다.
