A defendant shall be punished by imprisonment for two years.
Reasons
Punishment of the crime
【Opening of cell phone with stolen names of victims, and settlement of small amount using such names, etc.】
1. On February 21, 2019, the Defendant forged private documents: (a) around February 21, 2019, at the mobile phone sales store of “D” located in Suwon Young-gu, Busan, the Defendant opened a mobile phone; (b) obtained and kept “B’s driver’s license” in the name of “B” without delay; (c) used this driver’s license to open the mobile phone in the name of “B” and received profits therefrom.
In order to open a mobile phone in the above date and at the same place, the Defendant: (a) entered the name, date of birth (F) and address (B) and other personal information on the “E new contract” on the paper of “E” kept at the above mobile phone sales store; (b) signed the name and signed the “H” on the back to that name; and (c) forged one copy of the “E new contract” in the name of another person’s document pertaining to the rights and duties or certification of facts; and (d) forged 17 copies of the mobile telephone contract in the same way from around that time to May 28, 2019, respectively.
As a result, the Defendant forged a new contract in the name of B, which is a private document on the right, duty, or certification of fact, for the purpose of exercising.
2. The Defendant sent a forged “E” new contract at the time, at the place, as described in paragraph (1) of this Article, to an employee with no knowledge of the name of the agency that opened the I mobile phone, by facsimile as if the new contract was duly formed, and sent it to an employee with no knowledge of the forged fact, as well as by attaching a file that can can be processed by facsimile transmission or forged mobile phone subscription contract between around that time and May 28, 2019 to e-mail, as described in the attached list of crimes, 17 copies of the new contract for subscription to mobile phone in the B’s name were sent to the employees with no knowledge of the forgery.
Accordingly, the defendant is named B.
