A defendant shall be punished by imprisonment for one year.

However, the execution of the above sentence shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

Although the Defendant, who is not a person dealing with narcotics, is not a person dealing with narcotics, is prohibited from dealing with clickphones (one philophones, hereinafter referred to as “philophones”), he dealt with philophones as follows.

1. Purchasing philophones;

A. On January 2018, the Defendant and C expressed in advance the entry of the D-U.S. Si, and expressed in advance to purchase the penphones from E to the above-lane for C driving, and C waiting in the above vehicle, and the Defendant conspireded to purchase the penphones in collusion with E with approximately 400,000 won in cash and approximately 0.7g of the penphones.

B. On February 2018, the Defendant and C: (a) expressed in advance to purchase a penphone from E in the residence of E located at the early port; (b) transferred KRW 1700,000 to E’s account; (c) the Defendant waiting on the said vehicle; and (d) the Defendant conspired to purchase a penphone by receiving approximately 3.5 g of a penphone at the said residence of E; and (c) the Defendant conspired to purchase a penphone by accepting approximately 3.5 g of a penphone at the said residence of E.

On February 2, 2018, the Defendant and C posted an advertisement to sell phiphones via the Internet, sent 400,000 won to the account he/she designates, and moved to the building located in Seocho-gu Seoul Metropolitan Government from the Seocho-gu, Seocho-gu to the C driver’s car, and the said person conspired to purchase phiphones by finding approximately 0.35 g of the phiphones which are hidden below the public toilet screen of the above building at the same time.

On March 2, 2018, the Defendant and C, on the Internet, sent KRW 400,000 to his designated account from a person who posted an advertisement to sell phiphones, and moved to a apartment complex located in Gangnam-gu Seoul Metropolitan Government, Gangnam-gu, with a C Driving Vehicle, and then find approximately 0.35 g of philophones concealed in the public telephone room at the same time.
