피고인은 2016. 10. 10. 14:00 경부터 15:00 경 사이에 강남구 B에 있는 C 앞에서, 공무원 10명과 마을 사람 20명이 있는 가운데 불법 현수막 철거 대집행을 위해 C을 방문한 강남 구청 D 인 피해자 E에게 “ 씹쌔 끼”, “ 씨 발 놈” 등으로 욕설을 하여 공연히 피해자를 모욕하였다.
