A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Night intrusion theft;
A. On May 2015, at around 02:00, the Defendant was in the Bupyeong-gu Incheon, Bupyeong-gu, Incheon, and the six-story nurses of D Hospital D Hospital, and opened and intrudes the entrance door of a escape room that was not corrected while the private nursing victim E is working for the said hospital, and then took up 50,000 won in cash, which was in the victim’s possession of the victim, and took out 50,000 won in cash, and 2,250 won in the market value.
Accordingly, the defendant invadedd the room occupied at night and stolen another's property.
B. On July 31, 2015, from around 01:55 to around 02:07 of the same day, the Defendant opened and intruded the entrance of the escape room that was not corrected during the process of the said victim E’s business, the Defendant laid out one driver’s license certificate of the victim in the household owned by the victim, one credit card (National Bank), two physical card (National Bank, Nonghyup), and two cash-related KRW 180,000 at the market price consisting of KRW 180,00,000.
Accordingly, the defendant invadedd the room occupied at night and stolen another's property.
2. On July 31, 2015, the Defendant violated the Act on Financial Business Specializing in Fraud and Credit Financial Business: (a) presented the F taxi card (the card number: G) of the National Bank of Korea (hereinafter “E”) that stolen as indicated in the paragraph (b) to the victim’s name as if the Defendant had the right to use the taxi properly; (b) obtained pecuniary benefits by paying the taxi fee; and (c) received property or pecuniary benefits by 133,300 won at a total of 10 times from that time until 08:21 on the same day, as indicated in the list of crimes in the attached Table.
The defendant, by deceiving victims, receives property or property.
