A defendant shall be punished by imprisonment for four months.

Punishment of the crime

1. On June 3, 2013, at around 03:39, the Defendant discovered that U was under influence of alcohol in front of the “T Pharmacy in Gwangju City,” and stolen the victim’s phone number pocket book, one (1), one (1), one (1), (1), (1), (1), (2), and (30,000,000,000,000,000,000,000,000,000,000,000,0000,000,000,000,000,000,000,000,000,000,000,000,000,000,

2. Fraud or violation of the Specialized Credit Finance Business Act;

A. On June 3, 2013, at around 03:54, the Defendant, using the modern card, which was stolen by U as referred to in paragraph (1) at V in Sungnam-si, Sungnam-si, Sungnam-si, by settling a total of KRW 26,600 on three occasions under the name of the victim as if the Defendant was a legitimate licensee of the said credit card, and instead using the credit card.

B. On June 3, 2013, around 04:21, the Defendant: (a) purchased tobacco from the victim as if the Defendant was a legitimate right holder of the said credit card; (b) purchased tobacco from the victim by deceiving the victim; and (c) paid the amount of KRW 7,500; and (d) illegally used the credit card.

C. On June 3, 2013, the Defendant: (a) around 04:27, at the Y point in the operation of the victim’s name in Seongbuk-gu, Sungnam-si, the Defendant: (b) used a stolen modern card, such as paragraph (1), and received alcoholic beverages, such as beer, etc. from the victim as if the Defendant was a legitimate licensee of the said credit card; (c) paid 19,000 won by deceiving the victim; and (d) illegally used the credit card.

3. The Defendant who attempted to commit fraud shall be U.S. at the Y station around June 3, 2013, as described in paragraph (1).
