Facts of recognition

A housing redevelopment project partnership for implementation of a housing redevelopment project (hereinafter “instant partnership”) is a housing redevelopment project partnership prescribed by the former Urban Redevelopment Act, which was approved by the Seoul Metropolitan Government on December 3, 1986, to remove existing buildings and newly build apartments, etc. (hereinafter “instant redevelopment project”) under the former Urban Redevelopment Act (repealed by Act No. 6852, Jul. 1, 2003; hereinafter “former Urban Redevelopment Act”) in the land of Seodaemun-gu Seoul Metropolitan Government (hereinafter “instant project site”).

As the former Urban Redevelopment Act was repealed on July 1, 2003, and the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents ( enacted on December 30, 2002 and enforced on July 1, 2003) was enforced on the same day, the cooperative of this case implemented the redevelopment project of this case as a housing redevelopment improvement project association under the Urban Redevelopment Act.

The instant association established a management and disposal plan on the site and buildings to be created under the instant redevelopment project and obtained authorization from the head of Seodaemun-gu Seoul Metropolitan Government on August 24, 1991. According to the above authorized management and disposal plan, the instant association newly constructed apartment buildings, sales facilities, and neighborhood living facilities on the land of 41,667 square meters in the area of the project site.

On April 14, 1998, the association of this case revised the management and disposal plan on October 20, 1998 following the resolution of the regular general meeting of union members, and was authorized by the head of Seodaemun-gu on October 26, 1998 to revise the above management and disposal plan.

The association of this case, such as the announcement of the sale in lots for apartment and neighborhood living facilities, completed the construction of a new apartment of 10 households and 855 households in the project site of this case on April 1993, and on February 26, 199, after receiving a certificate of completion inspection from the head of Seodaemun-gu on February 26, 199, it is not more than "public announcement of the sale in lots on April 28, 199."
