A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
[2014 Highest 1015]
1. Around 07:40 on January 15, 2014, the Defendant, along with C, intruded into the “F” of the victim E in YY-si, YY-si, YY-si, and the victim divided the property equivalent to KRW 13,000 in total, including two closed stuffs equivalent to KRW 7,000, market price of KRW 6,000, and one scrap metal equivalent to the market price of KRW 6,000, which was accumulated in the open-air site, and transferred it to ria installed outside the above solid space.
Accordingly, the defendant conspiredd with C to intrude the above structure, and stolen the victim E's property jointly.
2. On January 23, 2014, at around 23:00, the Defendant: (a) intruded into the construction site of a new building where the victim H located in Y G in YYY as the site manager; (b) carried the victim into the knife and stolen the knife who prepared 280 km of the steel bars in the market value, accumulated inside the construction site; and (c) carried them out in advance.
3. The Defendant: (a) knew that the tenant residing on the first floor of a single house owned by the victim I had a director; and (b) knew that the said house was influent with C, the tenant was invaded with C to steal the scrap metal, etc.; and
At around 11:00 on March 18, 2014, the Defendant, along with C, opened a locked door and intruded into the house outside of C by an indembly means, and stolen it with one LPgas tank equivalent to KRW 500,000 at the market price in the bend where C was in the bend column. At around 12:00 on the same day, the Defendant, upon intrusiond with C into the house of the said victim, removed and stolen it.
Accordingly, the Defendant conspiredd with C to the above structure, and stolen the property owned by C in collusion.
[2014 Highest 1154] The Defendant: (a) around 11:00 on April 25, 2014, the Defendant lost the Victim K in the Bori-ri Park located in Seocheon-gu, Seocheon-gu, Seocheon-gu, Seoul Special Metropolitan City on April 25, 201; (b) KRW 1000 in cash, which is owned by the Defendant, and one in the Hanri-gu Bank Crow card.
