A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2018. 12. 7. 23:23경 서울 은평구 B 지하 1층에 있는 ‘C’ 주점에서, ‘손님이 술값을 지불하지 않는다’는 112 신고를 받고 현장 출동한 서울은평경찰서 D 지구대 소속 경찰관 E으로부터 술값을 지불하고 귀가하라는 요청을 받았음에도 술값을 지불하지 않고 귀가하려 하다가 이를 제지당하자 화가 나 손으로 E의 멱살을 잡아 흔들고, 이에 경찰관 E 및 그와 함께 현장 출동한 같은 지구대 소속 경찰관 F, G으로부터 현행범인 체포를 당하게 되자 이에 저항하며 어깨로 경찰관 F의 얼굴을 1회 밀쳐 바닥에 경찰관 F의 안경이 떨어지게 하고, 위 주점 바닥에 누워 발로 경찰관 F, G의 다리를 수회 걷어찼다.

Accordingly, the defendant interfered with police officers' legitimate execution of duties concerning handling of 112 reported cases and arrest of flagrant offenders.

3. Circumstances favorable to the determination of sentence: A sentence shall be imposed in consideration of all the circumstances, such as the fact that the nature of the crime is inferior by exercising violence against a police officer in the course of performing official duties, the fact that a criminal record of violence has been several times, and the age, character and conduct, environment, motive and background of the crime, means and consequence of the crime, and the circumstances after the crime, etc.
