1. The Defendant-Counterclaim Plaintiff (Counterclaim Defendant) indicated attached Form 1 drawings among the land size of 32,704.4 square meters for the Plaintiff-Counterclaim Defendant (Counterclaim Defendant), 1, 2, 3.

A principal lawsuit and a counterclaim shall be deemed simultaneously.

1. Basic facts

A. On the ground of the 32,704m2 (hereinafter “instant site”) in the Seosung-si, the Plaintiff is a sectional owner of the said 101m2 (hereinafter “instant apartment and commercial building”). There are five D apartment units and one shop building (hereinafter “instant apartment and commercial building”), while the Plaintiff is a sectional owner of the said 101m2.

B. The Defendant, as a sectional owner of No. 105 of the instant commercial building, was the lessee of the instant commercial building No. 104, operated Schlage with the trade name “E” in the said No. 104 and No. 105, and operated the instant commercial building, installed the ground objects, such as air conditioners, in the attached Form No. 1 drawings No. 1,2, 3, 4, 5, 5, 66, 7, 8, and 28.6 square meters in sequence among the instant site, and occupied and used exclusively.

다. 원고는 이 사건 상가 101호를 주식회사 지에스리테일(이하 ‘지에스리테일’이라 한다)에 임대하였고, 지에스리테일과 가맹계약을 체결한 F이 위 101호에서 ‘G점’ 편의점을 운영하고 있는데, 이 사건 대지 중 별지 제2도면 표시 ㄱ, ㄴ, ㄷ, ㄹ, ㄱ의 각 점을 순차로 연결한 선내 (가) 부분 1.7㎡, 같은 도면 표시 ㅁ, ㅂ, ㅅ, ㅇ, ㅈ의 각 점을 순차로 연결한 선내 (나) 부분 11㎡, 같은 도면 표시 ㅊ, ㅋ, ㅌ, ㅍ, ㅊ의 각 점을 순차로 연결한 선내 (다) 부분 3.1㎡(이하 ‘이 사건 제2 점유 부분’이라 한다)에 위 편의점 운영을 위한 테라스, 컨테이너, 냉장고, 차양막 등이 설치되어 있다.
