피고인은 2013. 3. 28. 03:40경 청주시 상당구 B 아파트 702동 앞 노상에서, 불상자가 큰소리를 지른다는 112신고를 받고 현장에 출동한 청주상당경찰서 C지구대 소속 피해자 D이 신고자가 지목한 피고인에게 이름과 주민등록번호 등을 물어보았으나 대답하지 아니하여 그곳에 있던 피고인의 여자친구인 E에게 피고인의 인적사항을 묻자, D과 같은 소속 경위 F, 그 외 동네주민 3~4명이 있는 상황에서 피해자에게 “야, 씨발 새끼야, 씨발 좆까고 있네”라고 욕설을 하고, 이에 피해자가 피고인을 현행범인으로 체포하여 순찰차에 태우려 하자 “씨발새끼야, 내가 뭘 잘못했냐, 씨발놈들아 내가 무슨 잘못을 했다고 차에 태우려고 하느냐”라고 욕설을 하였다.
