A defendant shall be punished by imprisonment for not less than two years and six months.

In light of the above legal principles, the court below’s determination on the ground that the court below erred by misapprehending the legal principles as to “O” under Article 10 of the Information and Communications Network Act is justifiable and remanded to the court below for further proceedings consistent with this Opinion.

Accordingly, for the purpose of uttering, the Defendant forged one copy of the personal information-related consent form under the name of the O, a private document on rights and obligations.

4. The Defendant, at the time and place specified in paragraph 3, exercised a copy of the above written consent concerning personal (credit) information, as if it were duly formed, to a post office with no knowledge of the fact.

1. Forgery of private documents and the uttering of a falsified investigation document;

A. On March 12, 2015, the Defendant entered the name of the applicant in Q, resident registration number column, “R” in Q, and “S”, “S 30* 20* 20*,” and “S” in the workplace column, at the central branch of the Nonghyup Bank located in the Republic of Korea, on March 12, 2015, the Defendant signed the said Q Q in the name of the applicant.

Accordingly, for the purpose of uttering, the Defendant forged an application form in Q name, which is a private document on rights and obligations.

2) The Defendant filed an application for a credit card at the same time and place as referred to in the preceding paragraph, and submitted a forged application form to an employee in charge who is not aware of the forgery, and exercised it.

B. On March 6, 2015, the Defendant stated in the name column of “ Q”, “V” in the cell phone number column, “V”, and “W” column in the account number column, and signed Q Q in the name following the entry of “W” column in the account number column.

The defendant is entitled to exercise.
