Punishment of the crime

1. 피해자 B, 피해자 C에 대한 모욕 피고인은 2014. 7. 24. 15:30경 D에 있는 E경찰서 유치인면회실에서 유치인면회신청서를 접수하던 중, 면회를 오기 전 면회신청에 관해 물어보기 위해 담당 경찰관과 전화통화를 할 당시 기분이 나빴다는 이유로 위 경찰서 수사과에 조사를 받으러온 민원인 및 경찰관 등 다수인이 듣고 있는 자리에서 피해자 B(여, 30세)에게 “야 이 씹할년아! 무슨 전화를 그 따위로 받냐. 이 씹할년아! 내가 사식 물어보는데, 니가 공무원이면 다냐 어디 반말을 하고 지랄이야.”라고 욕설을 하고, 이때 옆에 있던 수시지원팀장인 피해자 C(54세)으로부터 “지금 어디 욕하는 겁니까 ”라는 말을 듣자 피해자 C에게 “야 이 씹할놈아! 내가 아까 전화를 받았는데 저 씹할년이 먼저 반말을 했다. 내가 녹음 다 했기 때문에 지금 감찰에 넘길 수도 있다.”라고 큰소리로 욕설을 하여 공연히 피해자들을 모욕하였다.
