Defendant shall be punished by a fine of KRW 1,500,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

B is to pay a certain amount of consideration to a person who acquires gains profits from the resale of an apartment under the name of another person after having sold the apartment in the name of the head of the Tong by using a passbook of another person. In order to enhance the possibility of winning the right to sell the apartment in the process, if the winning results are made by falsely transferring the apartment

Upon accepting the above proposal B, the defendant knew the crime to be supplied with the right of sale by disguised transfer and fraudulent means as follows.

1. No person who violates the Resident Registration Act shall file a false report on a resident registration;

Nevertheless, on August 22, 2012, according to the mother of B, the Defendant issued a certificate of certification required for the report of resident registration transfer to B in order to obtain the sale of C apartment in Daegu on August 22, 2012, and B filed a false report with the name of the Defendant in Daegu-gu D by using the certificate of official approval.

Accordingly, the defendant reported false facts in collusion with B on resident registration.

2. No person who violates the Act shall acquire or have others acquire a supply of deed, status or housing built and supplied under the Act by fraudulent or other illegal means;

Nevertheless, on November 21, 2012, according to the mother of B, the Defendant issued a certificate of seal impression, etc. necessary for the supply of the purchase right to B to purchase the C apartment complex located in Daegu on or around November 21, 2012, and B applied for parcelling-out and entered a false address as if the Defendant was residing in Nam-gu D, and submitted a false resident registration certificate, etc. as above, and received the winning of the sale right.

Accordingly, the defendant in collusion with B received the right to sell apartment units by illegal means.
