1. Forgery of private documents and the uttering of a falsified investigation document;

A. The Defendant, who was aware of a mobile phone hosting case, was able to bring revenue by opening a mobile phone in another person’s name or selling it to another person’s name. The Defendant liveded with the Defendant prior to his opening of the mobile phone.

On April 30, 2016, in order to open and sell a mobile phone in the name of C, and around April 30, 2016, in order to find the residence of C located in B located in B located in B located in B located in B located in B located in Gyeonggi-do, obtain photographs of C resident registration certificates of other C, send such photographs to the name and influence, and sell them by opening the mobile phone in C’s name.

On May 9, 2016, the Defendant: (a) around May 9, 2016, at the (ju) F ELS agency located in Gangnam-gu Seoul Metropolitan Government, made G, an employee of the said agency, under the direction of a person without a name, engage himself as if he was the wife of C; (b) required G to enter “C”, “H” and “C” in the column of the buyer’s application for mobile phone subscription stored in that area; and (c) issued G with the aforementioned forged mobile phone subscription application form as if it were duly formed.

Accordingly, the defendant, in collusion with the name-free person, forged one copy of the application for mobile phone subscription in the name of C, which is a private document on rights and duties without authority, and exercised it for the purpose of exercising.

B. The Defendant: (a) opened one cell phone of C’s mobile phone as above; and (b) opened a mobile phone in the name of C and sold the mobile phone in the name of C again; and (c) conspired with the name influence by raising profits.

Accordingly, on June 11, 2016, at the J agency located on the 6th floor of the I building of Gangnam-gu Seoul Metropolitan Government, the name-free person stated “C” and “C” in the column for buyers of the application for mobile phone compensation devices located therein and sign the application side.
