A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On April 10, 2016, the Defendant: (a) driven a BK5 car on April 10, 2016, and entered the DPG charging station located in Kimcheon-si Kimcheon-si, and (b) carried the victim E as if he would pay the price for gas filling to the said vehicle.

However, since the Defendant did not have a certain occupation or property and did not have a means of settlement, such as cash, at the time, there was no intention or ability to pay the price in stone even if he was provided with gas from the victim.

Nevertheless, the Defendant, by deceiving the victim as above, did not pay the amount of 34,050 GG gas equivalent to the market price of 34,050 won from the victim, and acquired it by deception.

2. Night-time buildings intrusion theft: (a) the Defendant was living while entering and leaving a car as specified in paragraph (1) owned by the Defendant without a given residence and occupation; (b) around March 2016, the Defendant: (c) arrived at the 194,000 resting area of the Gyeong-si, Kimcheon-si (Seoul Special Metropolitan City) and was living there at around March 18, 2016 and was living there; (d) opened a door located at four materials storages of the said Kimcheon-si (4): around April 18, 2016; and (e) intruded into a door, and opened a door and intruded into the door, and amounting to KRW 52,500 in the aggregate of the market prices owned by the victim Samsan Food Co., Ltd. and KRW 36,000 and KRW 20,000 in the market price, and cut it thereafter.

5. From October to October, part of the content of the list of crimes was revised according to the prosecutor’s amendment of indictment in the annexed list of crimes.

The property owned by the victim was stolen by the same method six times in total by intrusion into the above material storage at night, such as the statement.
