1. The defendant shall be the plaintiff.

1. The following facts may be found either in dispute between the parties or in full view of each entry in Gap evidence 1 to 4, appraiser D, and E's appraisal results, and the whole purport of arguments.

The land of this case was jointly owned by F and G. 373/51m2 (hereinafter “instant land”). Since then H purchased F’s equity shares on the instant land on December 10, 2001 through a compulsory auction procedure, the Defendant purchased from G on March 8, 2005 138/511 of G’s equity shares on the instant land, and completed the registration of ownership transfer on the same day, and thereafter, the Plaintiff purchased the entire instant land on November 28, 2013 at the first voluntary auction procedure (hereinafter “instant auction”).

B. Of the instant land, the portion of “4” portion of the ground concrete package, “4, 21, 22, 23, 9, 10, 20, 20, 20, 20, and 29 square meters on board, which is successively connected with each point of the attached drawings Nos. 1, 2, 19, 18, 17, 16, 15, 14, 14, and 51 square meters on the ground of “3” portion of “4, 4, 21, 22, 23, 9, 10, 20, and 3 are owned by the Defendant.

The Defendant, among the instant land, occupies a portion of 98 square meters in the ship that connects each point of 2, 3, 20, 13, 14, 15, 16, 17, 18, 21, 19, and 2 of the attached drawings among the land in this case as a marina, and occupies a portion of 23 square meters in the ship, which connects each point of 4, 5, 6, 24, 21, and 4 of the attached drawings, in sequence, 23 square meters in the same drawings, as a dry field, and uses a portion of 60 square meters in the ship, which connects each point of 7, 8, 9, 23, 22, 21, 24, 25, 26, 27, and 7 of the same drawings.
