1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Facts of recognition;
A. The defendant purchased land from D on March 15, 2003 and completed the registration of ownership transfer in the name of the defendant on April 24, 2003 with respect to each of the above real estate on April 24, 2003.
(F) The land in Busan, Seo-gu was merged with the land in Busan, Seo-gu on March 29, 2006. (b)
The defendant filed a lawsuit against G with Busan District Court No. 2005Kadan2008, and the above court rendered a decision on October 14, 2005 as stated in the following (1).
(1) G owned a building on the Seo-gu, Busan, E, F, and C’s ground (hereinafter “instant building”). Of the instant building, G is located on the Seo-gu, Busan, 2, 13, 12, 11, 10, 10, and 1 of the attached drawings (hereinafter “instant building”). Of the instant building, part of the instant building, which is located on the part of 11 square meters in line connected each point of 9, 16, 15, 14, 14, 7, 8, and 9 of the same drawings, which are 9 square meters in sequence connected each point of 8, 7, 21, 20, 19, and 8 square meters in line with each other of the same drawings, and 8 square meters in line with each of the instant items of 10, 11, 12, 13, 14, 15, 16, 10, and 17 square meters in line with each other.
(2) G removes the part caused by the inboard connecting each point of 11 square meters in sequence with the point of 1,2, 13, 12, 11, 10, 10, and 9 of the attached drawings among the coagus of Busan-gu, Seo-gu, E, and F ground block slate buildings with the Defendant, in Busan-gu, and the part caused by the inboard 8, 7, 21, 20, 12, 13, 14, 15, 16, 16, 9, and 9 of the same drawings; the part caused by the inboard connecting each point of 9, 16, 14, 17, 20, 19, and 8 square meters in sequence with the point of 10, 11, 12, 13, 15, 16, 9, and 10 of the same drawings; and the part caused by the above part of the land 7, 19,000 square meters
C. On September 22, 2007, the Plaintiff was constructed from G to G on the land of 36 square meters in Busan, Seo-gu, Busan, Seo-gu, 579 square meters.
