A defendant shall be punished by imprisonment for a term of one year and four months.
Reasons
Punishment of the crime
The Defendant, who operated the U Licensed Real Estate Agent Office in the Gangnam-gu Seoul Metropolitan Building Business Building T, was merely leased the Gangnam-gu Seoul Metropolitan Government CM apartment DT, the owner of DS, from the above DS, and required to pay debts and pay entertainment expenses, although he did not have been delegated the authority to conclude a monthly rent contract. As such, the Defendant was unaware of the victim by deceiving the victim as if he had the authority to conclude a monthly rent contract, deposit money, and receive monthly rent on behalf of the DS.
1. Around January 15, 2016, the Defendant drafted a letter of delegation using the aforementioned U.S.’s computer at the office of the above U.S. Licensed Real Estate Agent, and signed the form of “a” in the real estate column, “A” in the Gangnam-gu Seoul Metropolitan Government CM apartment DT, “DS” in the name of the delegating, “all matters concerning brokerage and management, such as the contract, entry, deposit, deposit, and receipt of the down payment and balance,” in the column of the matters to be delegated by proxy,” and “A” in the end, read “DS” as “DS: the seal in the above name of DS, which was rejected in advance, was affixed back to the horse’s DS.

On July 18, 2016, the Defendant prepared an apartment lease contract form using a computer at the above U.S.’s office, and signed and sealed the Defendant’s seal in the name of the said U.S. Defendant’s name after entering “DS A” in the column of the contents of the contract in the indication column of real estate. In addition, the Defendant printed out the form of “Seoul-gu Seoul-si CM apartment DM apartment TT,” “Seoul-gu, CM apartment DT, l million, the remainder l million, the rent KRW 1 million,” and the lessor column as “DS A”.
Accordingly, for the purpose of exercising the right, the defendant prepared an apartment lease contract (monthly rent) which is a private document on rights and obligations by gathering the qualification of agent of the SS.
