1. The Defendant shall pay to the Plaintiff KRW 38,390,320 and the interest rate of KRW 12% per annum from October 17, 2019 to the date of full payment.

Comprehensively taking account of the facts of recognition and the purport of the entire arguments in the evidence No. 1 to No. 4 (including serial serial numbers) of judgment, the Plaintiff is obligated to pay damages for delay calculated at the rate of 12% per annum as provided by the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings from October 17, 2019 to March 1, 2019, since the Plaintiff can recognize the fact that he/she supplied the Defendant with 364,984,070 won, such as ready-mixeds, etc. from December 28, 2017 to March 1, 2019. The Defendant is a person who received KRW 326,593,750 out of the price of the above goods from the Defendant. As such, the Defendant is obligated to pay to the Plaintiff the remaining amount of 38,390,320 won and damages for delay calculated at the rate of 12% per annum as requested by the Plaintiff.

2. The plaintiff's claim is justified.
