As to the facts charged in this case that the Defendant, while running beauty business, did not report as prescribed by the Public Health Control Act, the Defendant asserted that the Defendant did not violate the above Act, since the Defendant’s business does not constitute “maid art business”.

Article 2(1)5 of the Public Health Control Act provides that the business of beauty art business refers to the business of making the appearance of customers beautiful by taking good care of the faces, hair, skin, etc. of customers. Article 4(2) of the Enforcement Decree of the Public Health Control Act provides that the business of beauty art business is subdivided into beauty art business. In particular, in the case of beauty art business related to skin, it is the business of analyzing the skin condition, skin management, hair, eyebrow, eyebrow, etc. that does not use medical devices or medicines.
