A defendant shall be punished by imprisonment for four months.
Reasons
Punishment of the crime
1. The Defendant committed each fraud posted an advertisement to recruit the E business employees operated by the Defendant on the Internet NAV carbook and Blobs, etc., and attempted to obtain the victims who reported and contacted the above writing by deceiving the investment funds necessary for the Elosting sales business.
On March 29, 2015, the Defendant: (a) opened an Internet Kakao Stockholm room using a mobile phone used by himself; and (b) reported the advertisement text as above; and (c) made a false statement to the effect that “The Defendant would return twice the amount invested within 20 days if the Defendant made an investment in E engaging in the electricity siren sales business.”
However, in fact, the Defendant was not even registered as E, and even if he was not able to sell a siren to others, it was not possible for the Defendant to pay the proceeds due to the absence of a seller of an electrical siren, and even if he was paid the investment money from the victims, it was not possible to pay the proceeds. The Defendant merely prevented a return, such as the payment of the proceeds from the prior investors, and did not have the intent or ability to pay the proceeds normally
Nevertheless, on March 29, 2015, the Defendant received a total of KRW 13,850,000 from the victim AI to the foreign exchange bank account (G) in the name of the Defendant and received KRW 3 million from February 26, 2015 to April 8, 2015, including the transfer of KRW 13,850,000 from the victim including the above victim, on a total of 11 occasions during the period from February 26, 2015 to April 2015.
As above, the defendant deceivings the victims and received each property from the victims and acquired them by deceit.
2. On May 12, 2014, the Defendant: (a) leased one set of Nowon-gu (market price of KRW 6.50,00) from the victim AL operating equipment leasing business, such as a computer, using the trade name, “AK Computer” located in the Nam-gu Seoul metropolitan city; (b) leased one set of Nowon-gu (market price of KRW 6.50,00) from the victim on January 16, 2015; and (c) additionally leased one set of multiple periods (market price of KRW 4.50,00) from the victim on January 16, 2015.
