1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. On July 21, 1997, the Plaintiff, while serving in the Army on the Army, was suffering from the wounds of the “unclaimed wound and left bridge” (hereinafter “instant wound”), and applied for registration to the Defendant on June 26, 2012. However, on November 12, 2012, the Defendant rendered a decision that the instant wound does not constitute a person of distinguished service to the State on the ground that there is no proximate causal relation with the military performance of official duties (hereinafter “instant disposition”).
[Ground of recognition] Facts without dispute, Gap 2, 4, 5, 11, Eul 1 and 2, the purport of the whole pleadings
2. Whether the disposition is lawful;
A. The Plaintiff’s assertion is indicated in the written complaint around June 1998 as the date of the occurrence of an accident, but the date of the occurrence of an accident seems to be “ around June 1998,” in light of the respective descriptions of “A 6 and 11.”
In order to prepare for the censorship of military equipment, while towing a sprink, the accident was caused by the parts of the left clothes and the bridge between the sprink and the truck, and due to that accident, it was caused by the sprinking and the sprinking phenomenon, i.e., the occurrence of the wound and the wound so far. In light of these circumstances, there is a proximate causal relation between the wound of this case and the performance of military duties, but the disposition of this case by the Defendant was unlawful.
