Defendant shall be punished by a fine of KRW 20,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The defendant is an operator of a school vehicle of E, which is an English educational institute annexed to the English kindergarten attached to Busan Nam-gu, and the victim F (8 years of age) is a student of the above E.

1. The first-served crime on March 2013;

A. Around 17:00 on the first day of March 2013, the Defendant committed an indecent act by force against the victim under the age of 13, who was under the age of 13, as the victim stated that the victim would have completed a training course of an English private teaching institute in the vicinity of the said D kindergarten and would be close to the victim who intends to board his/her school vehicle, on the ground that the victim would have been the victim’s multi-party “responding to the prosecution”.

나. 폭행 피고인은 같은 일시, 장소에서 피고인이 피해자의 성기 쪽에 손을 갖다 대려 하였는데 피해자가 피고인의 손을 붙잡으며 “싫어요.”라고 말하며 거부한다는 이유로 피해자에게 “너, 집에 가라.”라고 말하면서 주먹으로 피해자의 머리를 꿀밤을 주듯이 1회 때리고 피해자의 뺨과 무릎을 손바닥으로 각 1회 때려 피해자를 폭행하였다.

2. The crime committed on March 2013;

가. 성폭력범죄의처벌등에관한특례법위반(13세미만미성년자강제추행) 피고인은 2013. 3. 하순 일자불상 17:00경 같은 장소에서 피해자에게 귓속말로 “고추 한번 보자.”고 말하면서 갑자기 피해자를 껴안아 13세 미만인 피해자를 강제로 추행하였다.

나. 폭행 피고인은 같은 일시, 장소에서 피해자가 강제로 껴안는 피고인을 밀어낸다는 이유로 꿀밤을 주듯이 주먹으로 피해자의 머리를 1회 때려 폭행하였다.

3. On April 2013, the Defendant committed the first-served crime on April 2013, 2013, which was parked in the same place at around 17:00, the Defendant: (a) placed the victim boarding the above school vehicle on the said school vehicle “a person who shows a prosecution”; and (b) placed the victim on a forced ground; (c) placed the victim’s fright and panty under the victim’s refusal to do so.
