A defendant shall be punished by imprisonment for a term of one year and two months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

[2015 Highest 530 Fraud] On October 28, 2014, the Defendant posted a false statement to the effect that the Defendant would sell 50,000 won mobile phones to the NAV Kabber Cine bulletin board, and that the Defendant would transfer money to the bank account to the bank account and send the mobile phone to the bank account.

However, the defendant did not have the above mobile phone, and there was no intention to send the mobile phone even after receiving the price.

Ultimately, the Defendant received 50,000 won from the victim D to the national bank account in the name of the Defendant.

The Defendant, including that, from October 13, 2014 to April 17, 2015, received a total of KRW 2,440,000 from the victims by the same method over 34 occasions, as shown in the first list of crimes in attached Table 1, from around October 13, 2014.

[2015 Highest 837 Fraud] On April 13, 2015, the Defendant posted a notice to the effect that “E is selling a cellular phone in gallon city” on the bulletin board, which is an Internet used goods transaction site at the military remote site, and false statement was made to the effect that “the Defendant will immediately deliver money to the victim F who reported and contacted this article.”

However, the defendant did not have the above mobile phone, and there was no intention to send the mobile phone even after receiving the price.

Ultimately, on April 13, 2014, the Defendant received 45,000 won from the victim to the Defendant’s single bank account.

[2015 Highest 1133 Fraud] On April 4, 2015, the Defendant reported a notice prepared by the victim G that he/she wishes to purchase PMP (portable multimedia device) on the bulletin board of the NAV (portable multimedia device) and made such a false statement to the victim that “on the face of remitting KRW 130,000 to the Defendant’s bank account, the Defendant would send PMP to the Defendant’s bank account.”

However, the defendant does not have a PMF and receives money from the victim as a cost of living.
