A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

1. On January 22, 2015, the Defendant posted a false statement to the effect that “I will sell franchising items” on the Internet by accessing the Internet through a mobile phone at the Defendant’s residence of 101, Busan Dong-gu, Busan, and then sent franchising items to D who reported and contacted 50,000 won.”

However, in fact, the defendant did not own the above clothing and attempted to use the money as living expenses by deceiving the money by pretending the sale.

As such, the Defendant, by deceiving the victim, received 50,000 won from the victim to the Busan Bank account (F) in the name of the Defendant’s leakage or in the same day, and acquired 5,980,000 won in total from the time to May 22, 2015 by receiving 14 times in all of the above methods, as shown in the annexed crime list, from May 22, 2015.

2. On May 22, 2015, the Defendant posted a false statement to the effect that “the last sale of 950,000 won is remitted to the victim G who reported and contacted with the Internet by accessing the Internet via a mobile phone at the Defendant’s residence of the Defendant, 101, Busan Dong-gu, Busan, and then sent the above doubt to the Defendant’s home-based dispatch.”

The Defendant, by deceiving the victim as such, received 950,000 won from the victim to the account of community credit cooperatives in the name of the Defendant under the pretext of paying for the goods.

Accordingly, the defendant was given property by deceiving the victim.
