Reasons
Punishment of the crime
Around August 24, 2014, the Defendant, “2014 Highest 5717,” written a false statement that “The sales of mobile phones” through the Internet opening site did not have intention or ability to sell mobile phones, and received KRW 400,000 from the victim C who believed to be true deposit of KRW 40,000 from a new bank account in the name of D, and received KRW 3,650,000 in total eight times in total, as shown in the list of crimes in the attached Table.
On March 14, 2014, the Defendant: (a) written a false statement to the effect that “on-site (on-site 5S)” was “on-site 480,000 won,” while having no intention or ability to sell mobile phones, and acquired it by transfer from the victim E who believed to be true.

1. At around 17:00 on September 12, 2014, the Defendant: (a) obtained 4.10,000 won from the I’s J bank account in the name of the foreign exchange bank, by deceiving the victim H to sell Aphone 5 cell phoness via the Internet opening site, even though the Defendant did not intend or have the intent to sell a mobile phone to the victim H; and (b) obtained 4.10,00 won from the I’s G bank account.
2. On September 17, 2014, the Defendant acquired KRW 440,00 from the I bank J account in the name of the foreign exchange bank by acquiring KRW 440,00 from the I bank account, by deceiving the victim K that the Defendant sold Aphone 5 cell phoness via the Internet prosperity site, even though he/she did not intend or have the intent to sell a mobile phone to the victim K.
3. Around 18:00 on September 15, 2014, the Defendant acquired 4.10,000 won through the I’s J bank account in the name of the foreign exchange bank, by deceiving that the Defendant sold opphone 5 mobile phones via the Internet without any intent or capacity to sell a mobile phone to the victim N, and thereby, acquired 4.1 million won through the I’s J account in the name of the foreign exchange bank.
