A defendant shall be punished by imprisonment with prison labor for not more than ten months.

The defendant shall pay 260,000 won to the applicant for compensation by fraud.

3.2

Punishment of the crime

around January 23, 2019, the Defendant posted a false statement to the effect that “D” games are “pop-up,” and that “pop-up,” the Defendant will send money to the victim E who reported and contacted the game,” and “on the face of the remittance of money,” at the Moel located in Seo-gu Incheon, Seo-gu, Incheon.

However, even if the Defendant received money from the victim E, the Defendant did not have any intent or ability to send the game money to the victim E.

The Defendant, from around May 9, 2019, received 120,000 won from the victim E through the F account in the name of the Defendant, by deceiving the victims in the same manner as shown in the attached Table 1 Crimes List from around May 9, 2019, and received a total of 11,126,90 won from the victims.

Accordingly, the defendant was provided property by deceiving the victims.

around April 28, 2019, the Defendant posted a false statement to the effect that “D” games are “pop-up,” and that “pop-up,” the Defendant would send money to the victim G who reported and contacted the game,” and “on the face of the transfer of money,” at the conference located in Seo-gu Incheon, Seo-gu, Incheon.

However, even if the defendant receives money from the victim, he did not have any intention or ability to send the game money to the victim.

The Defendant, from that time to May 15, 2019, received 40,000 won from the victim’s H account in the name of the Defendant, and deceiving the victims in the same manner as shown in the attached Table 2 Crimes List from that time until May 15, 2019, stated that “3,027,00 won in the indictment of KRW 2,969,000 in total from the victims,” but the evidence is recorded as shown in the attached Table 2 Crimes List.
