Punishment of the crime

1. Defendant A

A. The Defendant of the offering of a bribe was engaged in the agency business for advertisement display, such as banner and poster, on the trade name of Gangdong-gu Seoul Metropolitan Government F Building No. 307.

On October 6, 201, the Defendant issued a bribe in relation to public officials’ duties by providing three public officials of the Gangnam-gu Office with a total of KRW 10 million from September 7, 2011 to December 2012, 201, in a coffee shop where it is impossible to know the trade names located near Gangnam-gu, Gangnam-gu, Seoul, and 426 office, to B in charge of controlling and imposing fines for negligence on illegal advertisements, etc., on advertisements attached by the Defendant without permission or reporting, requesting a reduction of and exemption from fines for negligence, and issuing cash of KRW 3 million, as shown in the attached list of crimes.

B. From January 2007, the Defendant, as the actual operator of the victim’s (the victim)G from January 2007, has overall control over the operation of the company and the fund execution affairs.

From June 17, 201 to February 8, 2013, the Defendant received KRW 121,977,068 in personnel expenses for day-to-day workers who display the advertisements of the victim company from around June 17, 2011 to the new bank account in the name of the Defendant I and embezzled KRW 28,187,218 for the victim company by using them for personal purposes, such as living expenses.

2. Defendant B

A. From March 1, 2009 to February 28, 2012, the Defendant was working at H of Gangnam-gu Office and was in charge of regulating and imposing fines on illegal advertisements.

On October 6, 2011, the Defendant received 3 million won in cash in return for a request to regulate the advertisements attached by an advertising agent A and to reduce administrative fines, etc. at a coffee shop where it is impossible to know the trade name near Gangnam-gu Seoul, Gangnam-gu Office, Gangnam-gu, Seoul, and the Defendant is located in Gangdong-gu Seoul around October 28, 201 and around February 7, 2012.
