Defendants shall be punished by imprisonment for eight months.
However, each of the above defendants is against the defendants for two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
【Defendant B was sentenced to six months of imprisonment for fraud, etc. at the Incheon District Court on July 8, 201 and two months of imprisonment for fraud, etc. on August 2, 2011. On July 6, 2012, the judgment was finalized on July 14, 2012, which was sentenced to two years of suspension of execution to eight months of imprisonment for fraud, etc. at the Cheongju District Court on July 6, 2012. On September 6, 2013, the said judgment became final and conclusive on September 14, 2013.
【Criminal Facts】 The Defendants and E agreed to borrow money as security by forging the apartment charter contract for F apartment 101 and 506 of Seongdong-gu Seoul Metropolitan Government. Defendant A shared the role of false tenant in the above apartment building; Defendant B introduced the victim G with a pre-loan to borrow money; and Defendant A and Defendant B shared the role of forging the charter contract and seeking a person who is the owner of the house in order to borrow money.
1. 피고인 A의 위조사문서행사 범행 피고인 A, E은 위와 같이 공모하여 2011. 1.경 서울 동대문구 이하 장소를 알 수 없는 곳에서 행사할 목적으로 권한 없이, 피고인 E은 성명을 알 수 없는 브로커를 통하여 아파트전세계약서 용지의 부동산 소재지란에 “서울시 성동구 F아파트 101동 506호”, 보증금란에 “금 參億四阡萬원정(￦340,000,000)”, 작성일자란에 “2010년 12월 5일”, 임대인란에 “H”, 임차인란에 “A”라고 기재한 다음 H의 도장을 날인한 아파트전세계약서를 작성하고, 피고인 A는 위 아파트전세계약서 임차인란에 자신의 도장을 날인한 다음 2011. 1. 11.경 서울특별시 성동구 I장의 확정일자를 받아 권리의무에 관한 사문서인 H 명의의 아파트전세계약서 1장을 위조하였다.
