A defendant shall be punished by imprisonment for one year.

Punishment of the crime

1. On April 11, 2011, the Defendant forged private documents: (a) on D real estate of Seongdong-gu Seoul Metropolitan Government 130 A.M., the Defendant entered “F in the name column of the lessor” in the name of the office of real estate brokers, stating “F in the name of the lessor” and affixed the above F seal arbitrarily created following the name of the office of real estate brokers, on April 12, 201, stating “F” in the real estate indication column for the apartment lease contract form, “Seoul Seongdong-gu 107 Dong 2301, “A 2301,000 million won in the deposit column”.

Accordingly, for the purpose of exercising, the Defendant forged one apartment lease contract in the name of F, a private document on rights and obligations.

2. On April 13, 2011, the Defendant: (a) around 18:00 on April 13, 201, had been using the forged apartment charter contract as a document that had been duly formed, as seen above, to the Hyundai Capital Co., Ltd., Ltd.’s employee who was aware of the forgery in Seongdong-gu Seoul, Seongdong-gu Seoul E division G.

3. The Defendant, at the time, at the same time and place as set forth in paragraph (2) of this Article, proposed a forged apartment charter contract to an employee under the victim Hyundai Capital Co., Ltd.’s name-free employee, and had presented the forged apartment charter contract, which was duly formed by the lessorF. As such, the Defendant, as if the lessor had a deposit amount of KRW 170,000,000,000, was committed as if the deposit had been paid, and deceiving the said employee as if there were claims to refund the deposit money

As above, on April 18, 201, the Defendant, by deceiving the employees of the victim, received KRW 136 million from the victim, under the name of the head of the Cti Bank under the name of the Defendant, as a collateral loan for the lease deposit.

Accordingly, the defendant was given property by deceiving the victim.
