Defendant shall be punished by a fine of KRW 4,000,000.

If the defendant does not pay the above fine, 50,000 won.

Punishment of the crime

The Defendant is an operator of a E farm that installs six 1,365 square meters or more in Gyeonggi-gun D and raises approximately 900 heads of cattle.

1. Violation of the Wastes Control Act;

(a) Any person who intends to dispose of wastes shall ensure that wastes are not scattered or leaked in the course of collection, transportation, or storage, prevent the water from being leaked, and shall not transport the relevant wastes to any place other than a place where they can be properly disposed of, recycled, or stored, and in compliance with the standards and methods prescribed by Presidential Decree, but the Defendant, despite the fact that, from December 2012 to May 15, 2013, he/she discharged livestock excreta ( approximately 1.7 km per day), which he/she raised and discharged from the above E farm, and caused the contamination of the surrounding environment by neglecting it into neighboring farmland, such as making the water flow out.

B. Although a person who intends to recycle food wastes as food for his own livestock has to install facilities and equipment prescribed by Ordinance of the Ministry of Environment and report them to the competent authority, the Defendant, without reporting, received approximately 1,400 litress per day from F, etc., an unauthorized waste transportation business entity, and recycled them using food wastes for eating.

2. A person who intends to install a breeding facility with a size of at least 60 square meters in violation of the Act on the Management and Use of Livestock Excreta must file a report on his/her discharge facilities, and a person who raises livestock shall not have livestock excreta not properly disposed of flow into public waters, despite that livestock excreta not flow into public waters. However, the Defendant, around April 15, 2013, installed a breeding farm without filing a report, raising livestock excreta, leaving livestock excreta, dogs, etc. neglected to properly dispose of farmland, etc., so that livestock excreta flows into public waters adjacent thereto.
