1. The defendant is based on the transfer on January 12, 1970 of the real estate stated in the attached list to the plaintiff.

1. Basic facts

A. The An old-age repair cooperative was established on September 6, 1928, and was merged with the Young-dong Repair Cooperatives on November 30, 1961.

B. The Young-dong Repair Cooperative was amended by Act No. 948 of Dec. 31, 1961, and it was repealed by Act No. 2199 of Jan. 12, 1970; hereinafter the same shall apply) to the Young-dong Land Improvement Cooperative pursuant to Article 6 of the Addenda of the former Land Improvement Project Act (amended by Act No. 2199 of Jan. 12, 1970, which was enacted by Act No. 2199 of Jan. 12, 197, and its name was successively changed to the Young-dong Farmland Improvement Cooperative pursuant to Article 3 (1) of the Addenda of the former Farmland Improvement Project Act (amended by Act No. 5077 of Dec. 29, 195; hereinafter the same shall apply).

C. The Youngdong Farmland Improvement Association was dissolved pursuant to Article 8 of the Addenda to the Korea Agricultural and Rural Infrastructure Corporation and Farmland Management Fund Act (amended by Act No. 5759 of Feb. 5, 199) and merged with the Korea Agricultural and Rural Infrastructure Corporation established pursuant to the above Act, and the rights and obligations were comprehensively succeeded to the Korea Agricultural and Rural Infrastructure Corporation pursuant to Article 9

On December 29, 2005, the Korea Agricultural and Rural Community Corporation and Farmland Management Fund (amended by Act No. 7775 of Dec. 29, 2005) changed its name to the Korea Agricultural and Rural Community Corporation under Article 3 of the Addenda of the former Korea Agricultural and Rural Community Corporation and Farmland Management Fund Act (amended by Act No. 7775 of Dec. 29, 2005) and changed its name to the Plaintiff under Article 3 of the Addenda of the former Korea Rural Community Corporation and Farmland Management Fund (amended by Act No. 9276 of Dec. 29, 200

E. In 1928, the Anmpicing and Maintenance Cooperative established the Anmpic reservoir at the Anmpic Bari-ri, Dang-dong, Chungcheongnam-do, 1928, and the land listed in the attached list (hereinafter “instant land”) is an embankment of the Anmpic reservoir.

F. The defendant completed registration of ownership preservation on August 7, 1974 on the land of this case.

2. Determination as to the cause of claim

A. Article 15(1) of the Act provides that the former Agricultural Community Modernization Promotion Act (amended by the Ordinance of the Ministry of Agriculture and Forestry) shall obtain the authorization of the Minister of Agriculture and Forestry under the main sentence of Article 16.
