A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
When the defendant needs joint guarantor in order to obtain a loan, the defendant voluntarily stated the victim C as a joint guarantor, and decided to apply for the loan, and thought that he/she has stolen necessary documents, etc. or has received them directly.
1. On April 21, 2017, around 11:00 on April 21, 201, the Defendant: (a) came to “E” operated by the injured party on D2 stories in the Geum-gu, Busan; (b) divided the password of the entrance; and (c) intruded into the above skin shop; and (d) cut off the victim’s driver’s license, a copy of the victim’s license, and a copy of the business registration certificate with the victim’s driver’s license kept in the west; and (b) stolen it.
2. On April 21, 2017, the Defendant forged a private document: (a) stated “C”, “F” and “G” in the taxpayer column in the “application form for the issuance of national tax certification, etc.” for the purpose of exercising the right; (b) stated “C”, “F” and “G” in the “certification of income amount” and “certification of value-added tax standard” in the type of certification; (c) stated “C” in the applicant column and signed at the end.
Defendant continued to delegate the rights and duties with respect to the application and receipt of the above civil petition to the following delegated persons, on the back of the application form for civil petition such as issuance of national tax certification.
Using the power of attorney as described in the letter of delegation, “A”, “H”, and “employee I” were written in the taxpayers column of the power of attorney and signed and stated in the column of the delegated person.
As a result, the Defendant, for the purpose of uttering, committed the above Article 1(1) and 1(2) of the Civil Petitions including Issuance of National Tax Certification, etc. in the name of private document C, respectively.
3. The Defendant, at the same time and place as Paragraph 2, filed a civil petition, such as the issuance of national tax certificates, and the “agent” under the above forged name C.
