A defendant shall be punished by imprisonment for four months.

성명 불상의 전화금융 사기( 이하 ‘ 보이스 피 싱’ 이라 한다) 조직의 총책은 보이스 피 싱 범행을 할 각 단계별 가담자를 모집하여 이들에게 각자 할 역할을 위 챗 애플리케이션 등으로 지시하고, 성명 불상의 전화 유인책은 불특정 다수인에게 전화를 하여 검찰 직원을 사칭하며 피해자의 계좌가 범죄에 연루되었다는 취지로 기망하여 피해자들 로부터 현금을 인출하여 오게 하고, 피고인은 현금 수거 역할을 하는 성명 불상자들( 일명 ‘D’, 위 챗 아이디 ‘E’, ‘F’ 등 )로부터 메일로 전달 받은 금융감독원 명의 공문을 소지하고 금융감독원 직원 행세를 하며 피해자들이 인출하여 온 현금을 전달 받아 그 금액의 2% 의 수수료를 제한 나머지 금액을 현금 수거 책 역할을 담당하는 사람에게 전달하는 역할을 분담하여 보이스 피 싱 범행을 하기로 순차 공모하였다.
