A defendant shall be punished by imprisonment with prison labor for not more than ten months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

No person shall smoke or take in marijuana or its seed coats, and shall carry marijuana, its seeds, or its seed coats for the said purposes.

In addition, a person who is not a handler of narcotics is not allowed to cultivate marijuana or administer Metrophographs (one philopon; hereinafter “philopon”).

While the Defendant was not a narcotics handler, the Defendant administered philophones once, from November 2017 to around the 20th of the same month, using approximately 0.1g of philophones on the water, in the Defendant’s residence located in Gyeonggi-gun Group D during the period from around November 2017 to around the 20th of the same month.
