A defendant shall be punished by imprisonment for three years.
However, the execution of the above punishment shall be suspended for five years from the date this judgment becomes final and conclusive.

"2016 Gohap 259"
1. No person other than a person engaged in the cultivation of marijuana shall engage in any activity to cultivate marijuana;
Although the Defendant is not a narcotics handler, he cultivated the hemp for the purpose of manufacturing marijuana as follows:
A. On June 9, 2016, the Defendant: (a) ordered three marijuana seeds to be sent for cultivation or smoking at the English Internet “D”; and (b) received international postal items containing three marijuana seeds around June 15, 2016 at the same place of residence around Kim Sea-si 405; (c) around June 15, 2016, the Defendant received three marijuana seeds.
Then, the defendant from June 15, 2016 to the same year.
7. By the end of 26.2, 3 marijuana seeds purchased at the above Defendant’s residence were cut in indoor flowerss and were cultivated by supplying light of water, plant nutrition, and high voltage emission lamps.
B. On July 7, 2016, the Defendant ordered 7,000,000 U.K. Internet “D” shopping sites to send 7,000 won of marijuana seeds to the said Defendant’s residence for cultivation and smoking purposes. On July 14, 2016, the Defendant received three international mails containing the said seeds of marijuana in the said Defendant’s residence.
Then, the defendant from July 14, 2016 to the same year.
7. From 26.13:30 to the above defendant's residence, three of the hemp seeds purchased above were cut off in the indoor flowers, and the hemp seeds were cut off in the same manner as in the preceding paragraph.
2. No person who smokes or possesses marijuana shall smoke marijuana or its seed coats, or carry for the purpose of smoking;
The Defendant smoked the hemp seed coats and possessed marijuana for the purpose of smoking as follows:
A. At around 15:00 on July 24, 2016, the Defendant smoked with a string, mixed with tobacco dust, approximately 0.1g of its coats separated from six seeds of the hemp plant.
