1. The defendant shall be punished by imprisonment for six months;
2.Provided, That the execution of the above sentence shall be postponed for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. From Jun. 20, 2015, the Defendant: (a) around 09:39 on Jun. 20, 2015, at CPCs located in Seongbuk-gu, Sungnam-si, Sungnam-si, the Defendant had cash of 30,000 won, Samsung Card 1, and Nonghyup Card 2, on the computers used by the victim using the gapss.
Accordingly, the defendant stolen the victim's property.
2. Fraud and violation of the Specialized Credit Finance Business Act;
A. At around 09:51 on June 20, 2015, the Defendant: (a) purchased tobacco equivalent to KRW 45,000 at the market price and milk equivalent to KRW 1,000 at E convenience stores operated by the victim G in Seongbuk-gu, Seongbuk-gu; (b) presented the stolen Samsung Card under the name of D as if it was one of his credit cards; and (c) paid KRW 46,000 by means of signing the credit card device at the credit card terminal.
B. On June 20, 2015, the Defendant: (a) purchased goods equivalent to KRW 5,000 in the market value at H operated by the victim I in Sungnam-si; (b) presented the stolen Samsung Card under the name of Samsung Card as if it were one of his credit cards; and (c) paid KRW 5,000 by means of signing on the credit card terminal, as stated in paragraph (1).
C. Around 10:02 on June 20, 2015, the Defendant purchased goods equivalent to KRW 9,000,000, which were operated by the victims’ names in Sungnam-si, and presented the Samsung Card in the name of the stolen victim as if he were his credit card company, and paid KRW 9,00,000 by means of signing the credit card terminal as if he were his credit card company.
The Defendant, as seen above, induced the victims three times, received property from the victims, and used a stolen credit card.
