Reasons
Punishment of the crime
[Criminal Power] On September 27, 2019, the Defendant was sentenced to ten months of imprisonment for fraud at the Seoul Northern District Court, and completed the execution of the sentence on May 12, 2020.
【Criminal Facts】
1. Fraud;
A. On May 21, 2020, the Defendant, at around 09:30 on May 21, 2020, made a false statement as if he were to pay the price by ordering food to the victim D who operated the place in Seoul Jung-gu.
However, the defendant did not have the intent or ability to pay the price even if he received food from the victim.
The Defendant deceptioned the victim as above and acquired the victim's 15,00 won, i.e., the total market value of 15,000 won from the victim's seat, by being provided with misunderstanding and 2 soldiers.
B. On May 22, 2020, the Defendant made a false statement as if he were to pay the price by ordering food to the victim G, an employee, from “F located in Jung-gu Seoul Metropolitan Government E” at around 09:31.
However, the defendant did not have the intent or ability to pay the price even if he received food from the victim.
As above, the Defendant deceptioned the victim, i.e., the victim, who was provided with 24,00 won or more at the market price of 24,00 won, and acquired 3 soldiers from the victim.
C. Around 19:20 on May 23, 2020, the Defendant made a false statement as if he/she would order food to the victim J who operated the facility from “I” located in C, Jung-gu, Seoul.
However, the defendant did not have the intent or ability to pay the price even if he received food from the victim.
As above, the Defendant deceptioned the victim and acquired the victim with only 23,00 won in total from the market price of 23,00,000, i.e., Marri and 2, 200.
2. The Defendant interfering with business affairs one-third of the facts charged.
It stated that "I will do so because I will do not have any money." while having ordered food at the time and place stated in the paragraph, it means that "I will do so."
