A defendant shall be punished by imprisonment for four months.

Punishment of the crime

On October 26, 2012, the Defendant was sentenced to six months of imprisonment for fraud at the Seoul Southern District Court, and completed the execution of the sentence at the Sungsung Vocational Training Correctional Institution on March 4, 2013.

1. On May 28, 2013, around 21:30 on May 28, 2013, the Defendant ordered food at the E-cafeteria operated by Geumcheon-gu Seoul Metropolitan Government D Victim C to pay the cost normally.

However, there was no intention or ability to pay the price because of the lack of means of payment such as cash or card.

The Defendant acquired food amounting to KRW 18,00,00 from the victim, i.e., two-person powder and two-year beer, etc. from the victim.

In this respect, the Defendant acquired pecuniary benefits by deceiving the victim.

2. On June 1, 2013, around 18:50 on June 1, 2013, the Defendant ordered food at the H cafeteria operated by Geumcheon-gu Seoul Metropolitan Government G Victim F, and was committed as if the Defendant would normally pay the amount.

However, there was no intention or ability to pay the price because of the lack of means of payment such as cash or card.

The Defendant acquired food amounting to KRW 18,00 in total from the victim, namely, one knife and three knife, etc. from the victim.

In this respect, the Defendant acquired pecuniary benefits by deceiving the victim.

3. On June 13, 2013, around 07:00 on June 13, 2013, the Defendant ordered food at the K cafeteria operated by Geumcheon-gu Seoul Metropolitan Government J victim I to pay the amount normally.

However, there was no intention or ability to pay the price because of the lack of means of payment such as cash or card.

The Defendant acquired food amounting to KRW 47,00,00 from the victim, namely, one person of the sea beer and ten disease in the sea beer.

In this respect, the defendant deceivings the victim to use his property.
