Defendant
A, D, and F shall be punished by imprisonment with prison labor for one year, by imprisonment for 8 months, and by imprisonment for 4 months, respectively.
Reasons
Punishment of the crime
[2012 Highest 1572] Defendant E was sentenced to two years of suspension of execution on July 21, 2012 in Seoul Western District Court for special larceny, etc., and the judgment became final and conclusive on July 21, 2012.
1. Defendant A, B, C, and D play a role in purchasing smartphones or managing smartphones in accordance with the JJ’s direction while residing in Vietnam, in order to take advantage of the fact that only core chips can be used at the local site in Vietnam, by cutting off or acquiring smartphones in Korea from those who want to dispose of them, and selling them closely to Vietnam, and by selling them. The J moved in Vietnam to purchase smartphones that they stolen or acquired in Korea, and sell them at Vietnam. Defendant A moved in Vietnam to buy smartphones or instruct them to purchase smartphones or manage smartphones(K, etc.) in accordance with the JJ’s direction, while residing in Korea, Defendant B, C, D, and L were transferred from J or A to the account, and then purchased smartphones to take them out of Vietnam after purchasing smartphones.
