Reasons
1. Case history
A. On June 23, 2017, the Defendant first proposed “D” as a public-private partnership project under the Act on Private Participation in Infrastructure (hereinafter “Private Investment Act”) by FF Co., Ltd., E Co., Ltd., and G Co., Ltd. (tentatively referred to as “C Co., Ltd.”). Pursuant to Article 9(3) of the Act on Private Participation in Infrastructure, on June 23, 2017, the Defendant publicly announced the third party proposal HD (hereinafter “instant public-private partnership”).
B. The main contents of the instant notice pertaining to the instant case are as follows.

Documents for the receipt of project proposals and for the evaluation of the first-stage evaluation (written prior examination of eligibility for participation): By no later than 15 days from the day following the date of public announcement: The date of public announcement shall be excluded from the date of public announcement, and the date of receipt shall be no later than 18:00, and if the date of receipt is a legal holiday, the date of receipt shall be no more than 18:00 on the following day (Provided, That if the date of receipt is a legal holiday, the date shall be deemed a legal holiday): The Environment Corporation shall conduct an evaluation within 42 days following the Seo-gu Incheon Metropolitan City environment (the Seo-dong Comprehensive Environmental Research Complex), the date of receipt of the two-stage proposals, and the date of receipt of the documents for the first-stage evaluation (written prior examination of eligibility for participation) by no later than 15 days from the date following the date of public announcement: The person who has submitted the documents for evaluation of the first-stage evaluation (written examination of qualification for participation) shall submit the details of the proposal and other details of the project proposal to be submitted under the contract.
