1. The Defendant’s KRW 165,00,000 for the Plaintiff and 6% per annum from November 12, 2015 to December 12, 2016.
Reasons
1. Facts of recognition;
A. The Plaintiff is a company running the design and supervision business of buildings, and the Defendant is a company running real estate development, sales in lots, consulting business, etc.
B. On September 16, 2015, the Plaintiff and the Defendant entered into a service agreement with respect to the project for the development of the Kimpo Island (hereinafter “instant service agreement”) from September 16, 2015 to October 26 of the same year with respect to the service period in relation to medical facilities, lodging facilities, residential facilities, business facilities, commercial facilities, cultural facilities, and other ancillary facilities (hereinafter “instant service agreement”), and the part relating to the instant general terms and conditions of the instant service agreement relating to the instant case are as follows:
Article 1 (Purpose of Services) The purpose of this Agreement is to set forth the scope of services between A and B and the rights and obligations of both parties with respect to the project proposal and submitted items to be prepared by B (referring to the plaintiff) for the project of this case promoted by A (referring to the defendant) to be selected as the project object.
Article 3 (Scope of Services) (Scope of Services) (Scope) The scope of services to be provided to A shall be as follows:
(1) Construction of a site for one-stage 53,096 square meters (167,312 square meters) of the previous part of the business plan for the development proposal of this case (167,312 square meters): The period from the date of the contract to the date of the submission of the project proposal shall be from the date of the contract to the date of the submission of the project proposal, the period of service of Article 4 (Service Period) of the CD 1 of all documents related to CG, all documents, CD 4 (Service Period) of the project proposal, including the 2-stage 940,263 square meters (284,430 square meters) of the construction site (284,430 square meters) of the project proposal, including the arrangement plan, the program, the sculpture map, and the program.
Provided, That if a request for change of the ordering place is made not attributable to B, the period may be adjusted by mutual consent with A.
